OVERVIEW

This website is operated by Cabana Miami. Throughout the website, the terms “we,” “us,” and “our” refer to Cabana Miami.

These Terms of Service govern your access to and use of our website, products, showrooms, custom-design services, and related services. By visiting our website, placing an order, requesting a custom product, or purchasing from Cabana Miami, you agree to these Terms of Service and all policies referenced within them.

If you do not agree to these Terms, you may not use the website or purchase our products or services.

  1. ELIGIBILITY AND WEBSITE USE

You represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

You may use this website only for lawful purposes. You may not:

• Violate any applicable law or regulation
• Interfere with the operation or security of the website
• Introduce viruses, malware, or harmful code
• Attempt to gain unauthorized access to the website or related systems
• Copy, reproduce, scrape, resell, or commercially exploit website content without written permission
• Use the website to submit false, misleading, fraudulent, or unauthorized information

We reserve the right to refuse service, cancel an order, restrict access, or terminate an account when reasonably necessary to prevent fraud, abuse, unlawful activity, or a violation of these Terms.

  1. PRODUCT INFORMATION

We make reasonable efforts to present product descriptions, measurements, materials, finishes, prices, photographs, videos, and availability accurately.

Measurements are approximate unless expressly stated otherwise. Customers are responsible for reviewing all product information and confirming that an item is suitable for its intended location and use before purchasing.

Colors and finishes may appear differently because of lighting, photography, screen settings, natural-material variation, and handcrafted production. Photographs, videos, samples, renderings, prototypes, and showroom displays are representative and may not be identical to the delivered product.

We may correct errors, inaccuracies, or omissions and update product information at any time. If a material error affects an order already placed, we will contact the customer and provide any options required by applicable law.

  1. HANDCRAFTED AND NATURAL MATERIALS

Many Cabana Miami products are handcrafted from natural materials, including teak, Suar wood, reclaimed wood, rattan, bamboo, stone, concrete, shell, clay, metal, leather, natural fibers, and handwoven materials.

Natural and handcrafted products may exhibit variations in color, grain, texture, tone, shape, dimensions, knots, mineral markings, weave, surface movement, checking, hairline cracks, small separations, irregularities, and patina.

Wood naturally responds to humidity, temperature, climate, sunlight, and environmental conditions. Expansion, contraction, movement, checking, small cracks, fading, weathering, and changes in appearance may occur over time.

These characteristics contribute to the individual nature of each piece and are not, by themselves, considered defects. This does not exclude a genuine structural or manufacturing defect.

  1. OUTDOOR USE AND PRODUCT CARE

Products should be used outdoors only when specifically identified or approved for outdoor use.

Natural rattan and certain other natural materials are intended for indoor or covered use unless expressly stated otherwise.

Outdoor products may naturally weather, fade, oxidize, develop a patina, or change appearance over time. Teak and other natural woods may develop a gray or silver appearance when exposed to outdoor conditions.

Damage or deterioration caused by improper use, unsuitable exposure, standing water, extreme weather, misuse, lack of reasonable maintenance, or failure to follow applicable care recommendations is not considered a manufacturing defect.

  1. ORDERS AND ACCEPTANCE

Submitting an order does not guarantee acceptance. An order is accepted when Cabana Miami confirms it or begins processing it.

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, unauthorized payment, incorrect pricing, inaccurate product information, inventory errors, shipping limitations, or inability to fulfill the order.

If we cancel an order after payment has been collected, we will refund the applicable amount for the canceled merchandise to the original payment method.

Customers are responsible for providing complete and accurate billing, shipping, contact, and delivery information.

  1. PRICES AND PAYMENT

All prices are displayed in United States dollars unless otherwise stated.

Applicable taxes, shipping, delivery, freight, White Glove service, assembly, installation, storage, special handling, and other charges may be added to the order when applicable.

Shipping and delivery are not free unless expressly confirmed in writing by Cabana Miami.

Payment must be completed using an accepted payment method. By providing payment information, you represent that you are authorized to use that payment method.

We may correct an obvious pricing or calculation error. If an error affects an order already placed, we will notify the customer before proceeding whenever reasonably possible.

  1. PRODUCT AVAILABILITY

Product availability and inventory information may change without notice.

Items identified as available or in stock may be sold, reserved, damaged, delayed, or otherwise unavailable before an order is fully processed.

Pre-order, made-to-order, custom, and special-order timeframes are estimates based on information reasonably available at the time. Production and delivery dates may change because of manufacturing, materials, freight, customs, port congestion, carrier schedules, weather, or other circumstances outside our reasonable control.

  1. CUSTOM, MADE-TO-ORDER, SPECIAL-ORDER, AND PRE-ORDER ITEMS

Custom, made-to-order, personalized, modified, special-order, and pre-order items are final sale.

Specifications, materials, dimensions, finishes, colors, quantities, pricing, and other details may require written customer approval before production begins.

Once order processing, design work, material procurement, customization, or production has begun, the order cannot be canceled.

Customer-requested changes after approval may result in additional costs and delays and must be approved in writing by Cabana Miami.

Reasonable differences between samples, photographs, videos, renderings, prototypes, showroom pieces, and finished handcrafted products are not considered defects.

  1. SHIPPING AND DELIVERY

Shipping and delivery charges are calculated according to factors that may include item size, weight, quantity, destination, accessibility, delivery method, and special-handling requirements.

Available services may include local delivery, curbside delivery, freight delivery, or White Glove delivery, depending on the order, destination, and service availability.

Delivery and production dates are estimates unless expressly guaranteed in writing. Additional terms are provided in our Shipping Policy, which is incorporated into these Terms by reference.

  1. DELIVERY ACCESS AND CUSTOMER RESPONSIBILITIES

Before purchasing, the customer is responsible for confirming that merchandise can safely fit through and into the intended location, including entrances, doors, hallways, elevators, stairways, gates, loading areas, and other access points.

Unless expressly included in writing, delivery charges do not include:

• Hoisting or crane service
• Stair carries
• Special handling
• Assembly
• Installation
• Removal of existing furniture
• Storage
• Redelivery
• Additional labor caused by restricted access

Additional charges caused by inaccurate information, restricted access, missed appointments, customer unavailability, waiting time, failed delivery attempts, refused delivery without a qualifying reason, or special-handling requirements may be charged to the customer.

  1. RETURNS, REFUNDS, AND CLAIMS

Unless otherwise expressly agreed in writing by Cabana Miami, all sales are final.

Cabana Miami does not accept returns, exchanges, or cancellations because of a change of mind, personal preference, incorrect measurements, access limitations, color expectations, natural-material variation, aesthetic preference, or an item not fitting within the customer’s space.

Exceptions may apply when an item arrives with verified shipping damage, is materially different from the item ordered, or has a genuine manufacturing defect.

All claims and remedies are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.

  1. INTELLECTUAL PROPERTY

The website and its content, including product names, text, photographs, videos, graphics, logos, designs, renderings, and other materials, are owned by or licensed to Cabana Miami and are protected by applicable intellectual-property laws.

No content may be copied, reproduced, distributed, modified, published, displayed, used to create derivative works, or exploited for commercial purposes without prior written permission.

  1. CUSTOMER CONTENT AND COMMUNICATIONS

If you submit photographs, reviews, comments, feedback, designs, specifications, or other materials, you represent that you have the right to provide them and that they do not violate the rights of another person.

We may use communications and materials as reasonably necessary to process orders, provide customer service, investigate claims, complete custom projects, and comply with legal obligations.

We will not use customer project photographs for public marketing without permission when permission is legally required.

  1. PERSONAL INFORMATION

Personal information submitted through the website is governed by our Privacy Policy.

Payment transactions may be processed by Shopify and other authorized payment providers. Cabana Miami does not control the independent privacy practices of third-party providers.

  1. THIRD-PARTY SERVICES AND LINKS

The website may contain links to or integrations with third-party websites, payment processors, shipping providers, social-media platforms, and applications.

We are not responsible for the content, availability, security, policies, or practices of third-party services. Your use of third-party services may be subject to separate terms and policies.

  1. WEBSITE AVAILABILITY

We do not guarantee that the website will always be uninterrupted, secure, or free from technical errors.

We may update, suspend, modify, or discontinue any portion of the website when reasonably necessary. This does not affect obligations for orders already accepted except as permitted by these Terms and applicable law.

  1. DISCLAIMER

To the maximum extent permitted by applicable law, the website and its general content are provided on an “as available” basis.

General website content, styling suggestions, care information, and product recommendations are provided for informational purposes and do not replace professional architectural, engineering, installation, safety, or legal advice.

Nothing in this section excludes product obligations, warranties, rights, or remedies that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Cabana Miami will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, delay, loss of use, loss of profits, or circumstances outside our reasonable control.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, intentional misconduct, or other rights protected by applicable law.

  1. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Cabana Miami harmless from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the website, your violation of these Terms, or your infringement of another party’s rights.

  1. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

  1. NO WAIVER

A delay or failure by Cabana Miami to enforce a provision of these Terms does not waive the right to enforce that provision later.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute that may lawfully be subject to an agreed location will be handled in the appropriate state or federal court located in Miami-Dade County, Florida.

This section does not limit any consumer right that cannot legally be waived.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our operations, services, policies, or legal obligations.

The revised Terms will be posted on this website with an updated effective date. Changes will not retroactively alter an order already accepted unless agreed by the customer or required by law.

  1. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, order confirmation, approved custom specifications, and any written agreement signed or accepted by the customer, constitute the agreement governing the applicable transaction.

If a signed or specifically approved written agreement conflicts with these general Terms, the specifically approved written agreement will control for that transaction.
